These Terms of Service (“Terms”) govern your access to and use of the services provided by NFA Tags (“we,” “us,” or “our”), a company headquartered in New Hampshire, United States, including our website (nfatags.com), platform, QR code generation, document storage, and related features (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be a United States citizen or lawful permanent resident, at least 18 years of age (or the age of majority in your jurisdiction), and legally eligible to own and possess firearms (including any NFA-regulated items such as suppressors, short-barreled rifles, or machine guns) under all applicable federal, state, and local laws.
By using the Service, you represent and warrant that you meet these requirements. We reserve the right to refuse service or terminate accounts if we believe these conditions are not met.
To use the Service, you must create an account and pay the applicable one-time fee. You are responsible for maintaining the confidentiality of your account credentials (including your PIN) and for all activities under your account. Notify us immediately of any unauthorized access.
We use commercially reasonable measures to secure your data (including encryption in transit and at rest), but we cannot guarantee absolute security. You use the Service at your own risk.
You retain ownership of any documents, photos, PDFs, or other materials you upload (“User Content”). By uploading, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, host, process, display (via QR code links after PIN verification), and transmit User Content solely to provide the Service.
You represent and warrant that:
Uploaded content is user-generated and subject to U.S. federal and state laws. We do not monitor or pre-screen uploads but may remove or disable access to any User Content that violates these Terms or applicable law. ATF-issued approval documents (e.g., tax stamps or eForm PDFs) may contain your full Social Security Number (SSN) or other personally identifiable information, even though the SSN field is optional on many ATF forms.
Our service does not review, edit, or redact User Content. Failure to redact sensitive information may expose it to risks inherent in any digital storage system. We recommend redacting (blacking out or permanently removing) that information using appropriate PDF editing tools before uploading it to the Service.
We do not respond to requests for User Content or account information from law enforcement, government agencies, or third parties without a valid U.S. court order. We will notify you at the email address on your account if we receive such a request.
We aim to provide the Service with 99.9% monthly uptime (excluding scheduled maintenance). “Monthly Uptime Percentage” is calculated as (total minutes in the month minus Downtime minutes) divided by total minutes in the month.
Downtime excludes scheduled maintenance (notified in advance), force majeure events, your internet/equipment issues, third-party outages, or attacks (e.g., DDoS, hacking attempts).
If we fall below 99.9% uptime in a calendar month (and you report it within 30 days), you may be eligible for a service credit of up to 10% of your one-time fee (prorated if applicable), applied to future services or as otherwise determined by us. This is your sole remedy for downtime. We provide no other warranties regarding availability.
We implement reasonable technical, administrative, and physical safeguards to protect User Content (including encryption and PCI-Compliant storage). However, no system is completely secure, and we are not liable for unauthorized access, data breaches, hacking, DDoS attacks, or other security incidents beyond our reasonable control, or for any risks arising from User Content that contains unredacted sensitive information (see Section 3). You acknowledge that uploading sensitive NFA documentation carries inherent risks.
The Service, platform, QR code system, design, text, graphics, and other content (excluding User Content) are owned by us or our licensors and protected by U.S. copyright, trademark, and other laws. You receive no ownership rights beyond the limited license to use the Service as permitted.
You agree not to:
We may suspend or terminate access for violations.
Fees are one-time and non-refundable except as expressly stated. We may add optional paid features (e.g., waterproof QR prints) in the future.
We may terminate or suspend your account for any reason, including suspected violation of law or these Terms. Upon termination, access ends, and we may delete User Content after a reasonable period (subject to legal retention obligations).
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFA TAGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR, FOR ONE-TIME FEES, THE FEE PAID).
You agree to indemnify and hold us harmless from claims arising from your User Content, violation of these Terms, or misuse of the Service.
These Terms are governed by New Hampshire law, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in New Hampshire. You waive any objection to venue or inconvenient forum.
We may update these Terms. Continued use after changes constitutes acceptance. We will notify you of material changes via email or in-Service notice.
These Terms constitute the entire agreement. If any provision is invalid, the remainder remains enforceable. No waiver of any breach is a waiver of subsequent breaches.
